1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and TRYEVAL TECHNOLOGIES PRIVATE LIMITED ("TryEval," "we," "us," or "our"), a company registered in Gurugram, Haryana, India.

By accessing or using the TryEval platform at tryeval.com (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. You must be at least 18 years of age to use the Service.

2. Description of Service

TryEval is an AI evaluation platform that enables users to evaluate AI models and endpoints. The Service includes dataset management, evaluation rubric configuration, statistical metric computation, LLM-as-a-Judge evaluation, human-in-the-loop review, and evaluation reporting.

The Service is offered through various plans (Free, Starter, Growth, and Enterprise) with different feature sets and usage limits as described on our Pricing page. We also provide a browser-based Try Free tool that runs entirely in your browser without requiring an account.

3. User Accounts

To access certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials and not share them with others
  • Promptly update your information if it changes
  • Accept responsibility for all activities that occur under your account

If you create or manage an organisation account, you are responsible for all users within that organisation and their compliance with these Terms.

4. Service Plans and Fees

The Service is available under multiple plans with different pricing and feature sets as described on our Pricing page.

  • Billing: Paid plans are billed on a monthly basis. Fees are charged in advance of each billing period.
  • Credits: Each plan includes a set number of evaluation credits. Each evaluation row costs 1 credit, with costs increasing based on token size for LLM-as-a-Judge evaluations. Some plans include overages at additional cost.
  • Changes: You may upgrade or downgrade your plan from your account settings. Upgrades take effect immediately; downgrades take effect at the start of the next billing cycle.
  • Cancellation: You may cancel your paid plan at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period.
  • Refunds: Refund requests are handled on a case-by-case basis. For refunds, contact support@tryeval.com.

We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing period.

5. Use License

Subject to your compliance with these Terms and payment of applicable fees, TryEval grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business and personal purposes in accordance with your plan.

This licence does not include the right to:

  • Resell, sublicence, or redistribute the Service or any part thereof
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to build or train a competing product or service
  • Remove or alter any proprietary notices or labels on the Service

6. User Content and Data

You retain ownership of all content you upload to or create on the Service, including datasets, evaluation configurations, and rubrics ("User Content").

By using the Service, you grant TryEval a limited, non-exclusive licence to process, store, and display your User Content solely for the purpose of providing the Service to you. This licence terminates when you delete your content or your account.

We do not use your User Content to train our or any third-party AI models. For full details on how we handle your data, see our Privacy Policy.

When using Try Free, all data is processed entirely within your browser and is never transmitted to TryEval.

7. Intellectual Property

The Service, including its design, code, algorithms, branding, trademarks, and documentation, is the intellectual property of TRYEVAL TECHNOLOGIES PRIVATE LIMITED. Nothing in these Terms transfers any intellectual property rights to you except the limited licence granted in Section 5.

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback to improve the Service without any obligation to you.

8. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
  • Scrape, crawl, or use automated tools to access the Service beyond normal use
  • Circumvent usage limits, credit allocations, or access controls
  • Resell or redistribute the Service or evaluation results for commercial purposes without authorisation
  • Use outputs from the Service to train models that compete with TryEval
  • Distribute viruses, malware, or other harmful code through the Service
  • Interfere with or disrupt the integrity or performance of the Service

9. Third-Party Services

The Service integrates with third-party LLM providers (such as OpenAI, Anthropic, Google, and Groq). Your use of these providers is governed by their respective terms of service and privacy policies. TryEval is not responsible for the availability, accuracy, or conduct of third-party services.

When using Try Free, API calls go directly from your browser to these providers. When using the full platform, API calls may be made on your behalf through our servers using the configuration you provide.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. TryEval makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that evaluation results will be accurate, complete, or suitable for any particular purpose. Evaluation results are generated by automated systems (including third-party LLMs) and should be reviewed and validated by qualified personnel before being relied upon for critical decisions.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • TryEval's total aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you to TryEval in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.
  • TryEval shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the cause of action or theory of liability.

12. Indemnification

You agree to indemnify and hold harmless TryEval, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Indian Contract Act, 1872, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.

14. Modifications to Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
